The Nursing Home Complaint Center Needs Elder Abuse Law Firms In Los Angeles, Miami, San Francisco, Phoenix & Major US Metro's

The Nursing Home Complaint Center was created by Americas Watchdog because there is no national advocate for nursing home wrongful death, or elder abuse. The Nursing Home Complaint Center has been designed to provide education to family members of nursing home patients, as to the signs of what could be neglect, and to high light short comings of the way nursing homes nationwide frequently mistreat their patients. As part of this initiative the Nursing Home Complaint Center wants to team up with elder abuse/wrongful death law firms, in order to give family members a resource in their city, or state, that can help, or provide assistance. What will participation mean for a law firm or lawyer in a major metro area in California, Arizona, Nevada Florida, Texas or any other state?
- The Nursing Home Complaint Center will endorse the law firm in a national press release for their specific metro area/state. The endorsement is designed to have a positive impact on Internet listings in the specific metro area/state of the law firm, as far as ranking.
- The Nursing Home Complaint Center will do weekly press releases focused on everything a family member, or possible victim should know about nursing home abuse, nursing home wrongful death, Medicare/Medicaid fraud, and possible class type issues. The weekly press releases will last for a year. Starting in October 2009 and going through November of 2010.
- The weekly press releases will encourage nursing home insiders to step forward, if they have specific proof of nursing home wrongdoing in their specific metro area. In the instances of insiders, the Nursing Home Complaint Center will work directly with the law firm assigned to that metro area, or state.
This is all about creating a consumer win, a win for the taxpayer and a win for the participating law firms. Because California, Texas, Florida and the entire Southeast are ground zero for nursing home abuse and neglect, the group is placing a major emphasis on these areas.
Only one law firm will be allowed in any top 100 US major market, with the exception of smaller states. In these instances the law firm or lawyer will be exclusive for the entire state.
According to the Nursing Home Complaint Center, “this is all about making a difference for the elderly, for the taxpayers, and for the family members of victims. If there is a highly regarded, personal injury, elder abuse, nursing home wrongful death law firm in a major metro in California, Texas, Florida, Arizona, Nevada, or any other state we want to hear from you.” There is a modest fee for participation in this year long initiative. You could generate a few problems if you drop them without some proper preparation.
First of all, your agreement with them may entitle them to a percentage of the settlement even if you fire them. You want to owe a third of the settlement to two different firms.
Second, when you fire them unjustifiably, they may be able to demand compensation "quantum meruit", which means that if the contingency they would have gotten had you not fired them is less than a standard hourly rate, they can demand the standard hourly rate. You could wind up giving the entire settlement to them.
Locate the state Bar association, and ask them about filing a Grievance, and see what they can tell you helpful. You have to be totally stuck, but if you do this right, you can create more problems than you solve.

OK obviously you are not a nurse. For one thing doctors fire nurses.Second of all no doctor would tell a nurse to " just stick to nursing". There are plenty of cases where we get to be a advocate. If a patient is having trouble with the texture of food they are getting(e.g. they may be missing teeth and need a minced or pureed diet) you can be their advocate and get that changed or re-evaluated.If a person is experiencing a side effect like nausea you can request an order for Gravol or the like from the doctor. You can let a doctor know if there is a concern with the condition that needs to be brought to their attention.You can let the doctor know if the pain meds ordered are effective or not. You can also advocate for a patient by referring them to other services that they may need for example social work or spiritual care.You can even advocate for a patient when you are not their nurse. Today I had a patient that has extensive wound dressings all over his body. I wrote on the Kardex that he should be medicated for pain prior to having his dressings changed because he told me that some nurses and it made the ordeal more for him. One time I advocated for a palliative patient that was having anxiety attacks. I politely told his family to rotate to visit instead of having about 20 loud Italians in this poor room making a racket. I also had them all leave at one point except for his wife so he could get some rest. Advocating does not always involve the doctor.
Any time your patient needs are not being met it is up to the nurse to act as the advocate.

You absolutely should get a lawyer. But also remember that the elder abuse folks are required to investigate every and that is for your sake. They are just doing their job. When they investigate, they are documenting the care your mother receives and her situation, which actually will provide evidence that you are not abusing your mother if that is the truth. They will come to know that the complaining is making it up if that is the case, but they do still have to keep investigating every complaint.

Similarly there are cases where school going kids have been framed and the kids and old helpless people were jailed.

That is a Republican stealing the Democrats ideas. Under Eric Holder of the Justice Dept and at direction, we have already had a fraud unit underway to investigate Medicare and Medicaid fraud. The Senator thinks the public is unaware of this, so he puts the idea as if it was a Republican idea. We have to ban politicians who servce in Congress from returning after 2 years and work as lobbyists. That should be illegal totally because they peddle influence with their former colleagues on behalf of lobby groups.
